Kafka's text then opens the way to another kind of deconstruction of that-which-is-already-deconstructed as performed by Jacques Derrida in his 1987 essay, "Before the Law."2 Although this claim may seem self-evident or rhetorically circular to some readers of Kafka and his commentators, it is the result of years of puzzlement concerning the impact of Grand Theory in American criticism.This puzzlement, often accompanied by antagonism, is shared by critics whose essays comprise Patia's and Corral's Theory's Empire: An Anthology of Dissent. The 2005 volume includes major reassessments of poststructuralist theory, notably Derrida's, by Tzetan Todorov, Thomas Nagel, M. H. While the deconstructionist idea of the arbitrariness of the signifier appears to be a central target of these critics' analysis, it is precisely the arbitrariness of the signifier called the Law that Kafka explores in The Trial.Kafka's intended relation to what he exposes has been much debated. [End Page 378] Stanley Corngold refers to the "undecidability" of Kafka's work and its "narrative mood of neutrality."3 The emphasis on "undecidability" in Kafka can be viewed as symptomatic of the influence of French Theory embraced by the American literary academy in the 1970s and 1980s. This latter view of Kafka's writing contrasts sharply with an earlier view, such as Hannah Arendt's, that The Trial, for all its ambiguity and multivalence, carries precise political meanings and warnings that Kafka fully intended. The deconstructionist moment did not bury convictions such as Adorno's or Canetti's that "from the beginning, Kafka sided with the humiliated,"4 or that for "a generation of early readers Joseph K.'s arrest was... a prophetic anticipation of the fate awaiting Hitler's victims."5 But deconstruction's skeptical effect undermined the certitude that Kafka was a politically important novelist. For its detractors, the deconstructionist view that there is "nothing outside of the text" ignores that texts like Kafka's have shaped human lives and human history. Wellek, who helped to introduce French theory to American literature departments, now asserts that theory has destroyed literary studies, while Frederick Crews argues that "Derrida's judgment that 'there is nothing outside the text' automatically precludes recourse to evidence." In Crews's view, "both Derrida and his myriad followers think nothing of appropriating and denaturing propositions from systems of thought whose premises they have already rejected." Thomas Nagel goes further in condemning "post-modern relativism" as a "quick fix" which puts reason to sleep. In Theory's Empire, Derrida's language is described as a "maze," a "prison house of language," a "limbo of combined attention and nonassertion."6The arguments against deconstruction theory can scarcely be summarized here, but a sampling of the commentaries in Theory's Empire on Derrida can lead us through and eventually back to what is or isn't at political stake in reading The Trial. This interview with Joseph Frank — best known as the author of a five-volume biography of Dostoevsky (published 1976 – 2002) and of Spatial Form in Modern Literature (1945) — was conducted in 2012 at Stanford and is published here, shortly after his death at age ninety-four, as a memorial to him. The conversation highlights Frank's representation of Dostoevsky as a critic and a satirist of the nihilist intelligentsia of nineteenth-century Russia — a portrayal that runs counter to the (...) understanding and use of his writings and his characters by Marxists, Nietzscheans, Freudians, Surrealists, crisis theologians, and Existentialists. Frank tells the story of how his friendship in the 1950s with Ralph Ellison, author of Invisible Man, led to Frank's teaching himself Russian in order to read Notes from Underground and write an article on the novella that changed the face of Dostoevsky scholarship. Liberalism’s concern with human freedom seems related to contractual freedom and thus contract law. There are, however, many strands of liberal thought and which of them best justifies contract is a difficult question. In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller offer a vision of contract based on autonomy. Drawing on the work of Joseph Raz, they argue that extending autonomy should be the law’s primary concern, which requires that we extend the range of contractual choices (...) available. While there is much to admire in their work, I argue that autonomy as conceived by Dagan and Heller cannot justify contract law. First, there are reasons to doubt the coherence of autonomy as an ideal. Second, given the pluralism of liberal societies, which, for example, often include substantial numbers of religious believers who reject core assumptions of autonomy theory, it is doubtful that such a theory can legitimate contract law. A more modest version of liberalism concerned primarily with protection against cruelty and providing a modus vivendi in pluralistic societies is more tenable. Such a vision of liberalism yields a more modest vision of contract law. Rather than making it into another means of realizing the dream of a more autonomous self, it is enough that contract law facilitates commerce and the marketplace. Markets in turn can serve an important — albeit limited — role in sustaining the peaceful cooperation and coexistence toward which a more realistic liberalism should aim. (shrink)

In his famous essentialist account of identity, Kripke holds that it is necessary to the identity of individual people that they have the parents they do in fact have. Some have disputed this requirement, treating it either as a reason to reject essentialism or as something that should be eliminated in order to make essentialism stronger. I examine the reasoning behind some of these claims and argue that it fails to acknowledge the complex and multi-faceted importance of biological process in (...) determining identity and distinguishing significant differences between biological and non-biological cases. In fact, this failure derives from an inherent tendency to treat the biological case in just the same way as the non-biological case at least at one important point in its history—the point of formation. This analysis offers a way of salvaging Kripke’s original claims. I focus in particular on the views of Graeme Forbes and Teresa Robertson, but also discuss the views of Nathan Salmon, M. S. There has been much discussion of whether there could be objects A and B that are “individuatively vague” in the following way: object A and object B neither determinately stand in the relation of identity to one another, nor do they determinately fail to stand in this relation. If there are objects of this type, then we would have a genuine case of metaphysical vagueness, or “vagueness-in-the-world.” The possibility of vague objects in this sense strikes many as incoherent. The possibility’s (...) very description not only seems to talk of two objects but, much worse, it seems to point to a feature that distinguishes them: unlike object A, object B is not determinately identical to object A. This suspicion of incoherence is voiced in the famous arguments given against the possibility by Gareth Evans and Nathan Salmon. But the status of those arguments and others is uncertain. Here I present a new argument against vague objects — or more precisely, against the possibility of individuatively vague objects that satisfy an important and common additional condition that I will call “Democracy.” Since my argument turns on a connection between what is indeterminate and what is possible, I call it “the modal argument.”. To date, both the United States federal government and twenty-one individual states have passed Religious Freedom Restoration Acts that aim to protect religious persons from having their sincere beliefs substantially burdened by governmental interests. RFRAs accomplish this by offering a three-pronged exemption test for religious objectors that is satisfied only when (1) an objector has a sincere belief that is being substantially burdened; (2) the government has a very good reason (e.g., health or safety) to interfere; and (3) there is (...) a reasonable alternative to serve the compelling interest. Legal balancing tests like those found in RFRA are content neutral insofar as they sideline the belief-content of conscientious objections as irrelevant when determining the permissibility of granting legal accommodations. However, some theorists worry that this legal picture may be backward: perhaps balancing tests should be content non-neutral given the usual features of conscientious objections. For example, Yossi Nehushtan contends that, contrary to their typical codification, religious conscience beliefs seem undeserving of special legal accommodations because they possess uniquely strong empirical and theoretical ties to intolerance. Thus, the illiberally intolerant content of these conscientious objections might actually give the state a reason to refuse to grant legal exemptions. In this paper, I offer a cursory defense of content neutrality with respect to balancing tests like those found in RFRA. To begin, I outline Nehushtan’s argument for content non-neutrality. The cornerstone of his argument is that illiberal intolerance is intolerable such that conscientious objections that are based upon illiberally intolerant values provide the state with strong, normally prevailing reason not to grant an exemption. I argue that, even when the illiberally intolerant content of one’s conscience constitutes a weighty and relevant factor in determining the permissibility of granting a legal exemption, there remain significant problems. It is difficult, for example, to determine which views are illiberally intolerant and difficult to say whether illiberally intolerant views can effectively serve as the principled demarcating line in balancing tests. To conclude, I offer several cursory arguments in favor of adopting content-neutral approaches without necessarily making a comprehensive case. By drawing on the work of Amy Sepinwall, Nadia Sawicki, and Nathan Chapman, I show that content-neutral approaches can help to safeguard robust protections for conscience by permitting atypical exercises of conscience, protect minority thoughts and practices from being coercively supplanted by majoritarian understandings of morality, appropriately maintain the skepticism and humility that we owe each other as compatriots in a pluralistic society, and allow the kind of justifiable civil disobedience that has an important place in political history among other things. I propose to analyze the concept of basing beliefs on reasons. The concept is an important one in understanamg the so-called "inferential" or "indirect" knowledge. After briefly stating the causal analyses of this concept given by D.M. Armstrong and Marshall Swain I will present two cases which show these analyses to be too strong and too weak. Finally, I will propose an analysis which avoids these twin difficulties.

In California Dental Association v. FTC, 119 S. Ct. 1604, the U.S. Supreme Court reviewed a decision by the U.S. Court of Appeals for the Ninth Circuit that a nonprofit affiliation of dentists violated section 5 of the Federal Trade Commission Act, 15 U.S.C.A. § 45, which prohibits unfair competition. The Court examined two issues: the Federal Trade Commission's jurisdiction over the California Dental Association ; and the proper scope of antitrust analysis. The Court unanimously held that CDA was subject (...) to FTC's jurisdiction, but split 5-4 in its finding that the district court's use of abbreviated rule-of-reason analysis was inappropriate.CDA is a voluntary, nonprofit association of local dental societies. It boasts approximately 19,000 members, who constitute roughly threequarters of the dentists practicing in California. Although a nonprofit, CDA includes for-profit subsidiaries that financially benefit CDA members. CDA gives its members access to insurance and business financing, and lobbies and litigates on their behalf. Members also benefit from CDA marketing and public relations campaigns. (shrink)

Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. However, rejecting these generalizations for a more (...) nuanced view still has dramatic implications for the status quo in both health policy and clinical ethics. (shrink)

Why do sports fans sometimes (often?) go crazy at sporting events and then afterwards proceed with their day as if nothing much happened? If something of genuine significance happened, something that warranted the emotional ups and downs the fan experienced during the game, why don’t its effects linger? These questions pose a version of the puzzle of sports fandom. Others have applied Kendall Walton’s theory of fiction to solve the puzzle, but Walton’s account of sports fandom fiction is unacceptably thin. (...) Recent attempts by Nathan Wildman and Joseph Moore to address this thinness problem fail. We answer the thinness objection by explaining how sports fandom is a collaboratively authored fiction, constructed by fans, sponsors, players, teams, media commentators, and more. The stories of sports fandom fiction are passed to new generations of fans in a way more reminiscent of The Iliad or The Romance of the Three Kingdoms. It is proposed to remove the difficulty of nonitegrability of length in the Weyl geometry by modifying the law of parallel displacement and using “standard” vectors. The field equations are derived from a variational principle slightly different from that of Dirac and involving a parameter σ. For σ=0 one has the electromagnetic field. For σ<0 there is a vector meson field. This could be the electromagnetic field with finite-mass photons, or it could be a meson field providing the “missing mass” (...) of the universe. In cosmological models the two natural gauges are the Einstein gauge and the cosmic gauge. With the latter the universe has a fixed size, but the sizes of small systems decrease with time and their masses and energies increase, thus producing the Hubble effect. The field of a particle in this gauge is investigated, and it leads to an interesting solution of the Einstein equations that raises a question about the Schwarzschild solution. (shrink)

Divine conceptualism takes all abstract objects to be propositions in the mind of God. I focus here on necessary propositions and contemporary claims that the laws of logic, understood as necessarily true propositions, provide us with an epistemic bridge to theological predication—specifically, to the claim that God exists. I argue that when contemporary versions of DC say ‘G/god’ they merely rename the notion of necessary truth, and fail to refer to God. Given that God is incomprehensible, epistemic access to the (...) state of propositions in the mind of God is extremely limited. (shrink)
